Structuring Your Note Sale Agreement

Options for structuring Note Sale Agreement
  1. Full Purchase:
    a.   The Note Company purchases all remaining payments on your Note.
    b.   You receive the purchase price of the Note in cash, at the closing.
    c.   You have absolutely no liability if the borrower ever defaults on the loan at some point in the future.
    d.   This option will provide you, the Note Seller, with the largest amount of cash for your Note.

  2. Partial Purchase:
    a.   The Note Company purchases a specific number of payments.
    b.   You retain all rights to the remaining payments after our interest is satisfied.
    c.   This option will provide you, the Note Seller, with less cash than if The Note Company were to purchase all remaining payments on your Note.  However, you may find this option preferable for any number of reasons that are specific to your particular situation.

  1. The Note

  2. Payment History
    a.   Payment history report from third-party loan servicing company; or
    b.   Other primary-source documents that reliably evidence payments:
       i.)  Bank deposit slips or account statements that show the date and amount of each payment; or
       ii.)  Copies of cancelled checks

  2. Title Insurance (1% of amount owed on Note)
  3. Escrow fees ($300 - $400)
  4. Recording fees ($50 - $100)
  5. Tax certificates ($50 - $100)
  6. Credit Report ($25)
  7. Courier / Overnight document delivery fees

Closing Costs that YOU pay
  1. Fees for legal or other work needed so that you can provide us with marketable and insurable title.
  2. All closing costs for loans with less than twelve (12) months' "seasoning".
